The bad cheque bearer’s damage caused by the illegal and culpable act of the company’s – appellant’s lawfull agent, who had issued them knowing the nonexistenct capital reserves at the payer – bank, at the time of issue and payment. The damage is in casual connection with this act. The bad cheque bearer’s nominal damage caused by the harm at reputation and reliability when appeared as an insolvent company in front of the bank – payer. The litigation is partly accepted and the apellants are condemned to restitutio in integrum of the damage.
